TERMS & CONDITIONS

Plain English License

In this license, we're going to include our terms and conditions in plain English because we like plain English. Please read the following carefully, and if you don't agree to all terms then don't download, install, or use our software.

1. Our software is offered as a service and we agree to let you use our software as long as you pay for the service. You don't own the software and we don't give you the right to use it if you don't pay for the service. We don't give the right to sell, redistribute, reverse engineer, or otherwise tamper with the software. You agree to pay for the service even if a technical failure would allow you to continue to use the software without paying for the service and you agree to stop using the software if you don't pay for the service. We reserve all rights and our software is copyrighted.

2. Trading is risky and our software doesn't provide any trade recommendations nor do we. All trades are your exclusive responsibility. 

3. You absolve of us any and all liability for trading losses even if those losses are directly or indirectly the result of a malfunction of our software even if we were aware of that possibility. We've made every effort to ensure our software is reliable. But, the reality is that software is incredibly complex and as such may produce unexpected results in rare circumstances. We recommend that you keep a second computer available for order entry and keep your broker's phone number for the trade desk ready available. Not responsible for trading losses due to any reason. No warranty of any kind.

4. Our software requires that it connects briefly to our license servers to validate that you have a valid subscription. You must be able to connect to our license servers to use our software. This generally should not be an issue as its not possible to trade offline (except for market replay) and most computers are connected to the internet these days. We aim for 100% uptime during market hours but can not guarantee it. Any refunds or rebates for outages is at our sole discretion. I want to also share that I'll be using the same software over the same license servers. If we have any issues then we'll be adding a backup server in the coming months because it is very important for us. So, if you have issues then let us know immediately because we take any server outage as serious. 

5. You agree not to take legal action against us for any reason regarding our software or service. By downloading this software, you're giving up all legal rights up to the maximum extent possible under law to do anything "bad" to us or to attempt to harm our principles or company.

6. You also agree not to reverse engineer, tamper with our software, or our servers for any reason whatsoever.

7. You agree that we have the right to update our program, even requiring upgrades at times or overwriting our program for update functionality.

8. Privacy. We take privacy seriously. Our software transmits some information to identify your unique hardware signature. This is standard industry practice. This information is constructed in such a way it is not possible for us (or anyone else) to reconstruct personally identifiable information. We may implement exception reporting services for debug purposes only. Typically very limited to no identifying personal information would be available in such reports. You agree that you understand that our software may transmit limited information for debugging, troubleshooting, license information display, and diagnostic purposes only. You agree also to be contacted by us or placed on our private, never shared, cancel-any-time mail list.

9. You agree that we can modify these terms at any time without explicit notification. If our plain English is ever in doubt then the final meaning will be up to our lawyer.
